Settlement in Deer Lodge Mobile Home Park Septic Failure Case

Potomac Riverkeeper and the owner of the Deer Lodge Mobile Home Park (Park), Marcella Klinger, in Washington County, MD negotiated the terms of a consent decree; which was approved by Magistrate Judge Beth Gesner of the U.S. District Court for the District of Maryland on March 28, 2014. A complaint was filed on March 15, 2013 by Potomac Riverkeeper, alleging discharge of wastewater containing fecal coliform and e. coli bacteria from the mobile home park without an Clean Water Act NPDES permit. The wastewater, suspected of originating from failing septic systems, flowed through underground drainage pipes to a tributary of Conococheague Creek. Marcella Klinger denied these allegations; however, to settle the case, she has proposed to install a new wastewater treatment system to handle wastewater from 27 mobile homes.
